LA CROSSE, Wisconsin (WXOW) -- The state has asked to file new charges against two of four suspects accused of dumping a dead body in Red Cloud Park in August.
Deputy District Attorney Brian Barton, appearing before Judge Ramona Gonzalez Wednesday, said his office will charge 37-year old Christina Lorenz and 25-year old Cain Moss with first degree reckless homicide -- alleging the pair distributed a drug called fentanyl to 40-year old Anthony Ducharme.
Ducharme died of an overdose and Lorenz and Moss, as well as his father, 56-year old Robert Moss, and 59-year old Patrick Valiquette were charged with hiding a corpse after Ducharme's body was discovered in the park on La Crosse's North Side.
A motion hearing has now been scheduled for January 23, in which lawyers for Lorenz and Cain Moss are expected to file written motions in response to the District Attorney's request for the new charges.
Judge Ramona Gonzalez will also use that hearing to rule on whether or not the D.A. will be allowed to simply add the reckless homicide charges to the current case, or whether Barton will have to re-charge Lorenz and Cain Moss, in which case a preliminary hearing would have to follow.
Barton also said Wednesday he intends to hold a separate trial for Robert Moss and Valiquette -- since those two are not charged with homicide.
