Unless major errors are uncovered in the next few days, a recount will conclude that Republican state Sen. Van Wanggaard has lost his recall election.
Results posted Friday show that with 80 percent of ballots counted, Wanggaard has a net gain of 20 votes. However, he still trails Democratic challenger John Lehman by more than 800 votes.
The recount is expected to finish by the Monday deadline. If it does, both sides will have until July 10 to challenge the results in court.
Republicans have hinted they may file a lawsuit. During the recount it was found that an unspecified number of voters who registered at the polls failed to sign the appropriate poll book.
The state elections board says the error was an administrative oversight, not voting fraud.
