SPARTA, Wisconsin (WXOW) -- The 27-year old Sparta man accused in a 2009 fatal accident that killed his older brother has been bound over for trial.

Jason Schodeberg waived a preliminary hearing in Monroe County court Wednesday.

An arraignment date will now be scheduled.

Schodeberg's older brother was killed in a car wreck on Highway 33 in Cashton.

At the time, police were unable to determine who the driver of the car was. They allege Schodeberg fled the scene.

Police arrested him in the summer of 2012, alleging that DNA evidence recovered from the vehicle and witnesses coming forward had led them to believe he was the driver.

Schodeberg is charged with homicide by intoxicated use of a vehicle, as well as bail jumping, resisting or obstructing an officer and operating a vehicle with a revoked license in connection with the crash.
