WHITEHALL, Wisconsin (WXOW) - A homicide charge is filed against an Independence man after he hit an elderly woman crossing the street in January.
41-year-old Timothy Peterson faces one count of Homicide by negligent operation of a vehicle in the death of Cecelia Kilian.
According to the criminal complaint, on January 9, shortly before 6:00 p.m., the vehicle Peterson was driving hit Kilian as she crossed Washington Street.
Peterson told police he was texting around the time he hit Kilian. He told investigators he never saw the woman until she was on the hood of his vehicle.
Later investigation showed text messages in that time frame on Peterson's phone.
The 86-year-old Kilian was pronounced dead at a Whitehall hospital.
According to court records online, Peterson is scheduled to make his initial appearance in Trempealeau County court on October 1.
The homicide charge carries a maximum ten year sentence.
