Winona rental ordinance to be reviewed by appeals court

WINONA, Minn. (KTTC) -- The city of Winona's '30-percent rule' is getting attention again, as the Minnesota Court of Appeals is expected to take up a constitutional challenge to the rule.

The city ordinance says no more than 30-percent of homes on any block can be given rental licenses.

This law addressed concerns of noise and littering in areas near the town's three colleges.

Earlier this year a Winona County Judge ruled the law as constitutional.

But a group of homeowners argues the ordinance unfairly restricts their ability to use and sell their own properties.

Now the state's court of appeals will take up the issue and has 90 days to make a ruling.
