Felony charges filed against former Tomah mayor candidate

SPARTA, Wis. (WXOW) - Charges have been files against a former Tomah mayoral candidate over a criminal conviction.

On Thursday afternoon, Monroe County District Attorney Kevin Croninger charged Le Roy Kelsey with two counts of felony false swearing.

Kelsey had been a candidate for Tomah Mayor. Candidates are asked whether they've been convicted of a felony when they fill out their paperwork to run for office. State law prohibits people from holding office if they have.

According to the criminal complaint filed Thursday, Kelsey checked "no".

However, in 1990, he was convicted of felony theft by fraud.

According to the criminal complaint Kelsey admitted to an investigator that he was convicted of a felony in 1990 and was sentenced to 60 days in the county jail and three years probation. Kelsey told the investigator since he served his time and made restitution, he assumed the felony charges were dropped to a misdemeanor.  

The complaint states he also answered "no" on a similar form when he ran for, and won, a post as Tomah Alderman in 2011. He has since resigned his position.  The complaint said that when he found out about his ineligibility to run for office, he ended his mayoral bid.

Kelsey will appear in court on March 31.
