LA CROSSE, Wis. (WXOW) - A mental evaluation is set for a Madison man convicted in the drug overdose death of a Town of Barre man in 2013.
Malachi Hankel admitted selling heroin to Thomas Tremain who later died of an overdose in September.
Sentencing on a charge of 1st Degree Reckless Homicide was set for Tuesday. But one of Hankel's attorney requested a competency hearing Thursday stating that his client suffers from bipolar disorder and schizophrenia and has received psychiatric care.
"Malachi suffers from mental illnesses. He has diagnoses and appears to have been deteriorating in the jail and we don't think at this point, your Honor, that Hankel is in the position to continue to assist in his own defense," said Tom Locante, one of Hankel's attorneys.
Judge Todd Bjerke then ordered the evaluation.
Hankel is set to return to court at the end of April.
