Mayoral candidate makes initial court appearance

SPARTA, Wis. (WXOW) - Leroy Kelsey, the Tomah mayoral candidate charged with two counts of felony false swearing, made an initial court appearance Monday. 

Two counts of felony false swearing each hold a maximum fine of $10,000 and no more than six years in prison.  In court Monday a standard signature bond was set at $2,500.

According to the criminal complaint, Kelsey was convicted of a felony in 1990 for taking $7,000 from the Sparta American Legion. It is against the law to run for a state office if you have a felony conviction. When you fill out the paper work to run for Mayor, you're asked if you have ever been convicted of a felony.

Kelsey checked "no",  said Tomah City Administrator Roger Gorius. Kelsey told News 19 that he believed at the time that his felony was reduced to a misdemeanor. He would not comment any further on his case.

Gorius said Kelsey was notified by the Department of Justice that he can not run for Tomah Mayor. However, Gorius said his name will remain on the ballot because it's past the deadline for candidate filing.

If Kelsey wins the popular vote in Tuesday's election, by law he will not be able to be sworn into office. Gorius said the city would then have to appoint someone to fill the Mayoral seat until another election can be held.

Shannon Hough is the other mayoral candidate on the ballot. Kelsey has stepped down from his role on the City Council.
