Update on lawsuit against La Crosse Rental Inspection and Registration program

Posted:
LA CROSSE, Wis. (WXOW)  There is a new development in the dispute over the inspection and registration ordinance in La Crosse.

Local attorney Bernardo Cueto filed a lawsuit on behalf of two landlords in May... alleging the ordinance violates state law because it requires landlords to follow rules not required of other property owners.  In a release Cueto wrote, "Act 76 was designed to promote equality between homeowners and renters and protect renters from unreasonable rules created by local governments and intrusions of their home and privacy."

In response to the lawsuit, La Crosse Mayor Tim Kabat said, "we worked to make sure the final registration ordinance complies with state law."

Cueto asked for an order stopping the City from enforcing the ordinance.  On June 2, the parties reached an agreement.  According to a court stipulation and order, "The City of La Crosse agrees that it will not enforce its mandatory Inspection and Registration program for residential rental properties against the plaintiffs until the judge reaches a decision from the permanent injunction hearing held on July 11th at 1:30 p.m.  This stipulation is not conceding the merit of any issue on behalf of either party."
