UPDATE: Campbell Police Chief takes plea deal

LA CROSSE, Wis. (WXOW) - A plea deal is reached in the case of Town of Campbell Police Chief Tim Kelemen who was charged with a misdemeanor for signing up a tea party leader for dating, pornography, and other websites.

Following a court appearance Thursday afternoon in La Crosse County Circuit Court, Kelemen's attorney James Birnbaum and Monroe County District Attorney Kevin Croninger announced they've reached a diversion agreement.  In return for a no contest plea by Kelemen, the agreement requires him to continue his current counseling for an additional two years.  He would also perform 40 hours of community service.  If Kelemen abides by the agreement, the charge of unlawful use of a computerized communication system would be dismissed.

The diversion agreement was not discussed during the court hearing.  Judge Dale Pasell said he is recusing himself from the case since Kelemen has appeared in other cases before the court. An outside judge now needs to be appointed to the case to finalize the plea agreement.

Kelemen was released on a $1,000 signature bond.  He was also ordered to have no contact with Greg Luce, the man Kelemen used his work computer to target with a number of websites. Kelemen told investigators he signed up Luce for those websites because he believed Luce and other supporters were harassing his officers.

Kelemen's attorney, Jim Birnbaum, said the agreement does not prevent Kelemen from pursuing civil or criminal charges against those who made threats.

Kelemen is currently on administrative leave with the police department, and it is up to the Town of Campbell board to decide when and if he would return.
