La Crosse, WI (WXOW) -

The driver of a dump truck that caused a five car accident last summer on I-90 reached a deal with prosecutors in court on Monday.

Francis Rychtik admitted to investigators to drinking heavily the night before the crash and checking Facebook on his phone three times before rear ending 29-year old Jason Songer of La Crescent.

Songer was killed instantly.

Rychtik faced seven charges, all felonies, and pleaded no contest to homicide by intoxicated use of a vehicle and injury by intoxicated use of a vehicle. Both charges follow another intoxicant related conviction in 2012.

La Crosse County Circuit Court Judge Todd Bjerke asked Rychtik why he decided to waive his right to jury trial.

"I believe I would have been found guilty just based on the blood draw that there was alcohol in my system," he said.

Five of Rychtik's charges were dismissed by the court, but three will still be considered for sentencing.

He will be sentenced in July. Rychtik faces up to 52 years in prison and $125,000 in fines.
